Terms of Service

Effective date: January 1, 2023

These Terms of Service (“Terms”) govern your access to and use of Bluehaven’s websites, calculators/forms, SMS/email communications, estimate scheduling, and other online Services. Construction projects and professional services are governed by a separate written agreement (proposal/contract) that will prevail over any conflicting term here. By accessing or using our Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Who We Are

Bluehaven Builders, LLC is a Florida‑based contractor offering outdoor living projects (e.g., sunrooms, screen enclosures, pergolas), permit assistance for code compliance, plumbing contracting services, HVAC/Mechanical contracting services, underground and utility services, residential pool construction contracting and private project management services. Contact details are in Section 16.

2) Eligibility & Account

You must be at least 18 and capable of entering a binding contract. You may need to provide accurate information to request estimates or create an account in any customer portal. Keep credentials confidential and notify us of any unauthorized use.

3) Estimates, Calculators & Scheduling

Any online price ranges or calculators are informational and non‑binding. Site visits, engineering, material availability, building/HOA requirements, and code compliance can change pricing. Scheduling windows are estimates and may be adjusted for routing,

weather, inspections, or supply constraints.

4) Permits & Code Compliance (Informational Only)

We can assist you in preparing and submitting permit applications and resolving after‑the‑fact violations at your request and authorization. You are responsible for providing accurate information and promptly executing required documents. We are not a law firm and do not provide legal advice. Permitting timelines and approvals are controlled by authorities having jurisdiction. Fees charged by municipalities/third parties are your responsibility unless stated otherwise in your written contract.

5) Project Contracts; Change Orders; Payments

All project scope, schedules, warranties, and payment terms are governed by your signed proposal/contract. Deposits may be required to order materials. Changes in scope will be documented via written change orders that may affect price and schedule. Late balances may accrue interest/fees as permitted by law. We reserve rights under Florida’s Construction Lien Law.

6) Product Specifications & Hurricane Ratings

Any product ratings (e.g., wind resistance, impact) reflect manufacturer specifications and applicable approvals when properly installed and maintained and when used under rated conditions. Actual performance may vary due to site specifics and extreme weather. Nothing herein makes Bluehaven an insurer of property.

7) User Conduct

You agree not to: (a) misuse the Services; (b) interfere with or disrupt the site; (c) attempt to access non‑public systems; (d) upload unlawful or infringing content; (e) impersonate others; or (f) use the Services in violation of applicable law or HOA/permit rules.

8) Reviews, Testimonials & User Content

If you submit reviews, photos, or testimonials, you grant Bluehaven a non‑exclusive, worldwide, royalty‑free license to use, reproduce, display, and distribute that content for marketing and operational purposes, subject to our Privacy Policy. You represent you have the necessary rights to grant this license and that your content is truthful and lawful.

9) Communications; SMS Program

By providing your contact information, you consent to receive communications about your inquiries, estimates, scheduling, and projects. If you opt in to SMS, you agree to receive texts; message/data rates may apply. You can reply STOP to opt out and HELP for help. Our Privacy Policy explains how we handle data.

10) Third‑Party Services

Certain features may rely on third parties (e.g., maps, analytics, payment processors, financing portals, municipal sites). We are not responsible for third‑party services and do not control their terms or privacy practices.

11) Intellectual Property

All site content, trademarks, and materials are owned by or licensed to Bluehaven and protected by law. You may not copy, modify, distribute, or create derivative works except as permitted by these Terms or with our prior written consent.

12) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. ONLINE MATERIALS MAY CONTAIN ERRORS OR BE OUT OF DATE; WE DO NOT WARRANT THEIR ACCURACY OR COMPLETENESS. NOTHING HEREIN REPLACES YOUR WRITTEN

PROJECT CONTRACT.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEHAVEN AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUES, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED US$100 OR THE AMOUNT YOU PAID (IF ANY) FOR THE AFFECTED ONLINE SERVICE IN THE 3 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. THESE LIMITATIONS DO NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW.

14) Indemnification

You agree to defend, indemnify, and hold harmless Bluehaven from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your content, or your violation of these Terms or applicable law.

15) Dispute Resolution; Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict‑of‑law rules. Mandatory Arbitration & Class Action Waiver (Consumers): Except for small‑claims actions, any dispute arising out of or related to these Terms or the Services will be resolved by binding arbitration on an individual basis under the rules of JAMS or AAA (administrator to be selected by us), held in Palm Beach County, Florida, in English, with one arbitrator. YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. This Section does not limit your rights where arbitration clauses are unenforceable. You and we may seek injunctive relief in court for IP misuse or data security incidents.

17) Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted with a new Effective Date. Your continued use after changes means you accept the new Terms.
